The repairs are not my issue. I whole-heartedly believe that the car will be repaired properly with new parts by people who know what they're doing. My issue is if the car appraisal comes up $3000 less than what it was before the accident. Their insurance company needs to cut me a check for $3000 and I will see to it that they do. The car will be appraised and I will provide GEICO documentation. If they refuse I will file a complaint with the California Department of Insurance against them and take them to small claims court. That's the process and it works.

I just read a post on another site where a guy was offered $215 diminished value. He filed a complaint against the insurance company and ended up getting $2500. Know your rights and follow through.
I guess I am looking at this from a different angle. I keep my cars until they die or give them to someone who needs them. Buying a new car is a 12 to 15 years event for me unless circumstances call for it. The last car I sold or traded in was 2003

No worries, brother. Everyone hasctheir own thoughts and ideas regarding this kind of process.

My point is if the car is worth $3000 less I'm gonna get that money and pay it to my loan. I plan on trading it in for a Type-R once repaired and I'm not going to go upside down on my loan when I can fix it by sending a few emails and making a few phonecalls. The responsible party needs to bear the financial burden and believe it or not I got this advice from the father of the teenager who hit me. I was very kind to his son after the accident and he wants to make sure I don't deal with any of his consequences. He called a friend of his that works for an insurance company to get advice that he then passed along to me. Treat people with respect and you get respect in return.

I guess if you are going to get $3K in your pocket it is worth it!

That'll buff right out. :) Seriously though, I'd make darn sure the carfax doesn't even hint at frame damage in the accident report because you're looking at an ~8k loss. It may as well be a rebuilt at that point. Unless you can find some sucker to sell it to who won't check the carfax, though that'd be slightly dishonest.

Yeah I would never try to swindle someone like that. There will be a professional appraisal that I will pay for and GEICO is going to pay the difference whether they want to or not.
