never trust ANYTHING an insurance company tells you!!

they only look after themselves and will do the cheapest thing possible!!

sue the at fault driver YOURSELF!!
Agree, consult your own lawyer don't go through your insurance.

I guess the real question for those who were in accidents that were the fault of someone else and then saw there rates go up.......how much did they go up by? If it was $100 annually or so, it would be really hard to tell if this wasn't just from other environmental factors. There has been a lot written about insurance claims rising significantly over the past decade due to tech on cars increasing the payouts for minor accidents and higher accident rates linked to cell phone usage. Rates would likely go up annually anyways with a clean record. Before I bought my CTR, my rates went up ever year or two with a perfect record. Side note, don't get Allstate......my 2002 CIvic Si cost more to insure than my 2017 CTR and 2002 Civic Si combined when I switched with AAA. I did end up hitting a retread ($6,000 worth of damage) with my CTR about 8 months after getting it, and my next rate was about $100 more annually......so I can't really say if that was environmental factors or the retread.

On the issue of high deductible plans......when I was pricing out plans, it was like $300 cheaper to do a $1,000 deductible vs a $500 deductible annually. Since I doubt any of us get into accidents on a annual basis.....or we likely be uninsurable. It always makes sense to go with the higher deductible plans, if you go 2 years without an accident then you've saved money. And if you were like me......went like 15 years, I could've saved $1,000s. I honestly didn't look at the gap between $1,000 and $1,500, but I probably should.....or whatever the upper limit is for my company.

$200 sounds cheap for a professional paint job. Was the shop inside a garage and they used spray cans?:D
Nah, it was actually the shop next door to the tint shop where I got my ceramics installed. Turned out to be one of those tell em' I sent ya deals when I asked my tint installer if the body shop was any good. Looks factory and the paint matches perfectly.

This is insuranc bullsh**. My friend had his and 4 other cars sideswiped at night by a DUI driver. Their company called and was scaring him into thinking they "only" had ~10 grand of policy to cover. He fought with them until they paid him the full value of the car.

I've always just filed through my insurance company and let them deal with the other insurance. And then refuse to talk to the other insurance company......your insurance company has an incentive and the resources to maximize their recovery.

Crank it buddy your monthly will drop SIGNIFICANTLY and not like you're going to claim a 600-1000 dollar anything on the car, so why not :) There is a max though most places it's around $1500-2000
Quite the contrary, I prefer a low deductible ($100) so that I can indeed file small claims ($200+) and not have to come out of pocket much. Helps for things like when I was in a fender bender a few months ago with like only $1600 damage, I only have to pay $100. Someone backed into me in a parking lot too, about $800 of damage and only $100 out of my pocket.

I'm sure it depends on the insurer but it is worth it for me. Only ~$25/month difference between $100 deductible and $1000, so it's a no brainer.

Also, FWIW if your insurance is raising rates on you, regardless of whether you're at fault or not, I'd find a new insurer. I've had both at-fault and not-at-fault claims on my car, and my rate has only ever decreased over time, never gone up (with the exception of when I first bought my car, since it was newer than my previous car). FWIW I pay about $110/mo right now through AAA, which is cheap for around here (New Orleans).

He ONLY ($%##$) has $5000 limit for property damage.

...he only has $5000 property damage coverage - all claims will be prorated and divided from the $5000.

My insurance company highly recommends I just proceed with repair on my policy (I do have a $500 deductible) and they will "sue" him / his insurance company for the cost. Of course - my rates will increase.

What should I do? Advice please.
  1. Listen to your insurance company... They know more than anyone on this forum.
  2. Have you been told your rates will increase? If not, one shouldn't assume... again, talk to your insurance company.
  3. Why are you asking legal advice from unknown people on a car forum and not speaking to and listening to your insurance company? Your situation is common, so again, trust your insurance company.

The bare minimum in KY is $10,000 liability, so I have $300K in uninsured motorist and basically don't have to worry about anything.

While I understand you're trying to help, that information has no bearing. Insurance coverages and deductibles vary by state, as both are set by each state's Dept. of Insurance.

All this talk makes me appreciate the fact my cars are 10 years old. We only carry liability with no collision/comprehensive coverage. Deductible is sky high. Premiums are dirt cheap. If my car gets wrecked, I will take the loss and buy a new civic. Win/win if you ask me.

Can those who says their premium went up for a not at fault insurance claim specify the insurance provider? It might help some people out.

My experience with Progressive, Geico, USAA, StateFarm have all been good, no run around and they all let me choose the shop I get my repairs at and I always picked the same body shop that specifically sources OEM parts.
