And dont trust the angle of the dashcam sometimes it looks like im driving out of lane.
I can verify this, not sure if it’s not angled perfectly right but it always looks like I’m slightly out of lane, plus whenever I do have a close enough call to check out on the camera it never looks as close on video

You maybe could have moved more over to the right but then again the infiniti driver should have turned more to his right, too.
Thats my plan i just moved a little to the left and drive slowly just to make the pedestrian safe and my plan is after i pass the pedestrian i will go back again to the right because i always do the L type turn in that corner because head to head can possibly happen there. But the infiniti Cant react fast because she's driving to fast. She didn't observe,yield or stop if needed. she told to the police "i didn't see him" possible yes because that corner is blind spot.

Like i said if she drive slowly or at least yield she can avoid me. That corner is give or take.

Sorry about your accident that suv took a wide turn and going to fast good thing you have video a similar situation happen to a friend at a parking lot

The other driver is totally at fault. Idiots go zooming through parking garages where we're from, OP. I have a near miss almost every day downtown.

They're especially nuts around our Med Center area right there! Out of all places, you'd think people would be more careful...

thanks to all your feedback because im dying when the other driver insurance said to me that we both have responsibility in the accident. that's why I made a thread. hopefully the police report will favor on me or my insurance(state farm) will fight my case but Im still waiting the police report.

this is my first accident hopefully my last too or if shit happens again I hope minor damage only in my car. if this over I will update you all. Thanks again guys at least I saw more positive on your feedback but of course their the one who will decide. god bless civicx :)

Did you send that video to your insurance company? I would image that it would help push them to fight for you. Good luck!

Unfortunately, garages and parking lots tend to be 50/50. But in this case, you have video. You were pretty much STOPPED, and she hit YOU. I can’t see how this can’t at least be reduced to 75/25...

Do NOT say anything about you needing to avoid the pedestrian so you have moved slightly to the left...unless insurance asked about it.
You have the dash cam footage, just send it to the insurance and your claim adjuster. of course infiniti's insurance would argue that you are partially at fault. push your claim adjuster to push back. you stopped even before the turn and there is no physical proof that you were even over the line, no way it's your fault.

Of course the other driver's insurance will try to assign some blame on you. You're fortunate that you have an onboard video and that will help with your claim that the other driver was at fault. Talk to your insurance agent and have them fight to for you.

The Infiniti was going way faster than you were, and took the turn wide. In spite of what one of the other posters said, it does not look like you were going fast at all.
Not sure how much more to the right you could have moved. Timing was unfortunate as you turned just as the Infiniti also came around the turn. A couple of seconds either way and you probably would have missed each other.

Hey Honda 4life,

Sorry that you got into an accident, but I am glad that you didn't get hurt and this is a property damage claim. Although I might not be licensed to practice law in the state/jurisdiction where you reside or where the accident took place, I am attorney who has litigated a good number of motor vehicle accidents. As some have already pointed out, you were traveling up the ramp and it looks like you inched over to avoid a danger to the pedestrian who was loading the trunk of his/her vehicle. I would forward this dash cam video to the insurer of the adverse vehicle if you haven't already. The insurer may have denied your claim because of your command of the English language, because they don't have the video, or because their own driver has a conflicting statement. If the other insurer doesn't give you a settlement that you can agree to, you should contact your own insurer or retain a qualified attorney who is licensed to practice law in your jurisdiction.

You should also get copies of video surveillance footage that was taken by the parking garage as soon as possible. I am sure there are some video cameras inside there, but a lot of places have a 30 day retention policy. Since the accident happened on April 6th, I would do this immediately before they are destroyed. At least send them a letter to retain (and prevent from destroying) any video footage that may have recorded the accident.

If you got the contact information of the pedestrian who was loading the trunk, you can also try and get a witness statement. If it's favorable to you, you can send that to the insurer of the adverse vehicle for them to consider.

I hope this helps, but again, I might not be licensed to practice law in your jurisdiction and you should consult a qualified attorney in your jurisdiction for more information.
